Terms & Conditions

These Terms govern your use of the Questionful website at questionful.org and the Questionful application at my.questionful.org (together, the “Service”), and any paid plan you subscribe to. By creating an account or subscribing you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

2. Your account

You must be at least 16 years old to hold an account. You need to confirm your email address before the account can be used, and you are responsible for keeping your credentials secure and for everything that happens under your account. Tell us promptly if you believe your account has been accessed by someone else.

3. Plans, prices, and payment

  • The Free plan costs nothing and requires no payment method.
  • Paid plans are billed monthly or yearly in advance. Current prices are on our pricing page.
  • All prices are shown net of value added tax. VAT is calculated and added at checkout based on your location; an EU business receives the reverse charge once its VAT number has been verified.
  • Payments are processed by Stripe. We do not receive or store your full card details.
  • An invoice is issued for every charge and is available from your billing page.
  • A contract is formed when your subscription is confirmed and payment is taken.

4. Team seats

On the Teams plan, the base price covers three people: the account owner and two members. Every further member of a team you own is charged as a seat at the price shown on the pricing page, added to the same subscription. Changes are prorated by Stripe: a member joining part-way through a billing period is charged for the remainder, and a member leaving produces a credit. A person who is a member of more than one of your teams counts as a single seat.

5. Trials

Each account may start one 14-day trial of a paid plan. No payment method is required to begin it. If no payment method is added before the trial ends, the subscription is cancelled and the account returns to the Free plan automatically. We email you when the trial starts, shortly before it ends, and when it changes.

6. Renewals and cancellation

Subscriptions renew automatically at the end of each billing period at the then-current price, unless cancelled. We will give you reasonable notice before any price change affecting your renewal.

You can cancel at any time from your billing page. Cancellation stops future renewals; the plan stays active until the end of the period you have already paid for, after which the account returns to the Free plan. Data above the Free plan's allowances stays readable, only new activity is subject to the lower limits.

7. Right of withdrawal and refunds

If you are a consumer in the European Union, you normally have the right to withdraw from a purchase within 14 days of the contract being formed, without giving a reason.

Exception for immediate performance: by subscribing you ask us to make the paid plan available to you straight away. You acknowledge that you lose the right of withdrawal once the service has been fully performed, and that where you withdraw part way through you will pay a proportionate amount for the period you had access.

Beyond that statutory right: if something goes wrong with a purchase, email support@questionful.org and we will work with you in good faith to resolve it. Approved refunds are returned to the original payment method. Nothing in this section affects your statutory rights.

8. Plan limits

Each plan carries limits. The number of responses a form may collect in a calendar month, how much file storage the account has, and the size of a single upload. Current limits are on the pricing page. When an account reaches its response allowance its forms stop accepting new submissions until the next month or an upgrade; when storage is full, new uploads are refused. We warn you by email before either happens, and files already stored stay readable.

9. Acceptable use

You agree not to use Questionful to:

  • Collect data you have no lawful basis to collect.
  • Infringe the intellectual property or privacy of others.
  • Distribute hateful, illegal, deceptive, or harmful content.
  • Send unsolicited bulk email through the contact-list features.
  • Impersonate another person or organisation, or collect credentials or payment details under false pretences.
  • Attempt to disrupt, reverse engineer, overload, or gain unauthorised access to the Service.

We may suspend or close an account that breaches this section. Where it is reasonable to do so, we will contact you first.

10. Your data and your respondents' data

You own the forms you build, the responses you collect, and any data you import, on every plan. You are the data controller for the responses your forms collect and we act as your processor. See our Privacy Policy. A data processing agreement is available on request at info@questionful.org.

You are responsible for telling your respondents who you are and how their answers will be used, and for handling their data subject requests.

11. Our intellectual property

The Questionful brand, software, templates, documentation, and underlying systems remain the property of the operator named above. Nothing in these Terms transfers any right in them to you beyond the right to use the Service while your account is active.

12. Availability and disclaimer

Questionful is provided “as is”. We work to keep the Service reliable and available, but we do not guarantee uninterrupted availability or fitness for any particular purpose, and we do not offer a contractual service-level agreement unless one is agreed with you in writing. This does not exclude or limit any statutory rights you have as a consumer.

13. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited.

Subject to that, our total liability for any claim relating to Questionful is limited to the amounts you have paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data, except where it results from our failure to use reasonable care.

14. Third-party links and services

Our website and documentation link to services we do not control, and the Service lets you connect third-party tools such as Zapier, Make, or Google Drive. We are not responsible for the content, availability, or practices of those services, and a link is not an endorsement. Your use of a third-party service is governed by your agreement with that provider.

15. Changes

We may update these Terms from time to time. Material changes will be communicated by email or an in-product notice, and the version in force when you subscribe applies to that subscription period.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, where the operator is based. To the extent permitted by law, the courts of Germany shall have jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected and you may bring proceedings there.

17. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
